This Privacy Policy for IVI AMERICA, LLC (doing business as RMA New Jersey, RMA Philadelphia, RMA Florida, RMA Houston, RMA Lehigh Valley, RMA Northern California, RMA Seattle, RMA Southern California, Sound Fertility Care, Peak Men's Health, Ovatures, Conceptions Reproductive Associates of Colorado, Conceptions RMA, Pearl Mini-IVF) (collectively, “RMA”) describes how and why we might collect, store, use, and/or disclose ("process") your personal information when you use our services ("Services"), such as when you visit our websites (including https://rmanetwork.com, https://www.ovatures.com/, https://peakmen.com/, https://www.conceptionsrepro.com/, https://pearlminiivf.com/) and engage with us in other related ways, including any sales, marketing, or events.

Your Protected Health Information

RMA is a healthcare provider that is subject to the Health Insurance Portability and Accountability Act (“HIPAA”). If you are a patient of RMA and we collect your Protected Health Information, please review the HIPAA Notice of Privacy Practices made available to you by your RMA provider. This Privacy Policy does not apply to your Protected Health Information or describe our HIPAA practices.

Washington and Nevada Residents

Residents of Washington and Nevada may have additional rights related to their consumer health data. Please review our Consumer Health Data Privacy Policy.

WHAT CATEGORIES OF PERSONAL INFORMATION DO WE COLLECT?

Personal information refers to any information that can be used to identify you. The personal information we collect about you depends on how you interact with us. In general, the personal information we collect falls into the following categories:

  • Identifiers, including your name, address, email address, phone number, device identifiers (e.g., IP address and cookie IDs), and other similar identifiers.
  • Records about you, such as your gender, birthdate, and referral source.
  • Commercial information, such as billing information, information about Services you are interested in, details related to payment (including insurance information), and other commercial or financial information we may collect when providing the Services. All payment data is collected and stored by PayJunction, our payment processing vendor. You may find PayJunction’s privacy notice here: https://support.payjunction.com/hc/en-us/articles/211053648.
  • Internet or other electronic activity information, including the type of device and usage information, such as your browser and device characteristics, operating system, language preferences, referring URLs, device name, country, location, information about how and when you use our Services, and other technical information that does not reveal your specific identity (like your name or contact information).
  • Non-precise geolocation information, such as location derived from your IP address or GPS coordinates.
  • Professional or employment-related information, such as job title, organization, professional licenses and credentials, professional specialty, and other professional information that we may collect about you as a business contact or an applicant for employment.
  • Inferences drawn from any of the information we collect about your preferences or behavior, including to assess the level of interest in our Services.
  • Sensitive Personal Information, including:
    • Social Security Number, driver’s license, and other government identification documents
    • Passwords
    • Precise geolocation data
    • Racial or ethnic origin
    • Health information, such as information about a health condition or medical history as part of your use of the Services

SOURCES OF PERSONAL INFORMATION

We collect your personal information in the following ways, pursuant to applicable law: 

  • Directly From You, such as when you use or interact with our Services, request an appointment, scan one of our QR codes, sign up to receive emails or other communications or otherwise contact us.
  • Automatically Through Cookies and Other Tracking Technologies, such as when you visit our websites, use our mobile applications, open or click on emails we send you, or interact with our advertisements. Such technologies may include cookies, web beacons, clear GIF, pixels, and other data collection tools. For more information, please see the COOKIES AND OTHER TRACKING TECHNOLOGIES section below.
  • From Our Third-Party Partners, including from third parties that we have partnered with to provide you the Services you have requested from us.
  • From Publicly Available Sources, such as information collected for identification verification purposes.

Collection of Mobile Phone NumberIf you participate in our text messaging program, it is your responsibility to ensure that the mobile phone number you provide to us is accurate and unique to you, and that the phone number is not shared with any other individual. If you change your mobile phone number, it is your responsibility to contact us so that we can update our records.

HOW DO WE PROCESS YOUR INFORMATION?

We process your personal information for a variety of reasons. Depending on how you interact with our Services, this may include:

  • In connection with our Services. We may process your information when necessary to provide you the Services you request, request feedback, and to contact you about your use of our Services.
  • For internal business purposes. For instance, to maintain and improve our Services, develop new products and services, to identify usage trends and for other internal business purposes.
  • To send you marketing and promotional communications. We may process the personal information you send to us for our marketing purposes depending on your marketing preferences. You can opt out of our marketing emails and text messages by contacting us using the contact details provided in the section HOW CAN YOU CONTACT US ABOUT THIS NOTICE? below or following the unsubscribe instructions included in each such email or text.   • To deliver targeted advertising to you. We may process your information to develop and display personalized content and advertising tailored to your interests, location, and more.
  • To identify usage trends and determine the effectiveness of our marketing. We may process information about how you use our Services to better understand how they are being used so we can improve them. We may also use your information to better understand how to provide marketing and promotional campaigns that are most relevant to you.
  • For security purposes. We may process the information in order to enhance the security of your transactions and our IT systems, architectures, and networks to prevent fraud, criminal activity, or misuses of our services.

  • Advertising Partners. We may share your information with advertisers, ad platforms and networks, and social media platforms that help us place advertisements online.
  • Business Transfers. We may share or transfer your information in connection with, or during negotiations of, any merger, sale of company assets, financing, or acquisition of all or a portion of our business to another.
  • Legal Requirements. If required to do so by law or in good faith belief that such action is necessary to (i) comply with a legal obligation, including to meet national security or law enforcement requirements, (ii) protect and defend our rights or property, (iii) prevent fraud, (iv) act in urgent circumstances to protect the personal safety of users of the Service, or the public, or (v) protect against legal liability.

COOKIES AND OTHER TRACKING TECHNOLOGIES

We may use cookies and other tracking technologies (like web beacons and pixels) to access or store information. A “cookie” is a small text file that is placed on your computer or mobile device when you enter a website or a mobile app. It enables the website or mobile app to remember your actions and preferences over a period of time. While the cookies we may use change from time to time, they generally fall into one of the following categories:

  • Strictly Necessary Technologies. These technologies are necessary for the website to function and can’t be switched off in our systems. You can set your browser to block or alert you about these technologies, but some parts of the website may not work as a result.
  • Functional Technologies. These technologies allow for enhanced functionality and personalization. They may be set by us or third-party providers whose services we have added to our pages. If you don’t allow these technologies, then some or all these functionalities may not work properly.
  • Performance Technologies. These technologies allow us to count visits and traffic sources so we can measure and improve the performance of our website. They help us know which pages are the most and least popular and see how visitors move around the website. For example, we use Google Analytics to help us understand how users engage with the platform. Google Analytics uses cookies to track your interactions with the platform, then collects that information and reports it to us. This information helps us improve the Platform so that we can better serve you. If you wish, you can opt out of Google Analytics by installing the Google Analytics Opt-Out Browser Add-on.
  • Targetting Technologies. These technologies are set by our advertising partners. They may be used by those companies to build a profile of your interests and show you relevant ads on other sites. They work by uniquely identifying your browser and device. Some of the data these technologies collect may be considered sensitive in nature, including your health information. If you do not allow these technologies, you will not experience our targeted advertising across different websites where we purchase ad space.

We also use session replay tools, which record your interactions with our websites and mobile apps, such as how you move through our webpages and engage with our webforms. This information helps us improve our Services and identify and fix technical issues visitors may be having with them.

Some of the third parties we work with participate in industry groups that offer mechanisms for opting out of interest-based advertising. Residents of the United States can use the Digital Advertising Alliance’s mechanism at http://www.aboutads.info/choices/ and the Network Advertising Initiative’s mechanism at https://optout.networkadvertising.org/. Opting out of interest-based advertising using these tools will not opt you out of all advertising, but rather only interested-based advertising from us or our partners or representatives

HOW LONG DO WE KEEP YOUR INFORMATION?

We keep your personal information for as long as necessary to provide our Services, operate our business, and comply with our legal obligations. When we decide how long to keep your personal information, we consider the nature and sensitivity of the information, the potential harm from unauthorized use, the reasons we collected the personal information, and our legal obligations.

HOW DO WE KEEP YOUR INFORMATION SAFE?

We have implemented appropriate and reasonable technical and organizational security measures designed to protect the security of any personal information we process. However, despite our safeguards and efforts to secure your information, no electronic transmission over the Internet or information storage technology can be guaranteed to be 100% secure, so we cannot promise or guarantee that hackers, cybercriminals, or other unauthorized third parties will not be able to defeat our security and improperly collect, access, steal, or modify your information. Although we will do our best to protect your personal information, transmission of personal information to and from our Services is at your own risk. You should only access the Services within a secure environment.

DO WE COLLECT INFORMATION FROM MINORS?

We do not knowingly solicit data from or market to children under 18 years of age. By using the Services, you represent that you are at least 18 or that you are the parent or guardian of such a minor and consent to such minor dependent’s use of the Services. If we learn that personal information from users less than 18 years of age has been collected, we will deactivate the account and take reasonable measures to promptly delete such data from our records. WHAT ARE YOUR PRIVACY RIGHTS?

All of our users have the following privacy rights:

  • Opting out of marketing and promotional communications: You can unsubscribe from our marketing and promotional communications by clicking on the unsubscribe link in the emails that we send, texting “STOP” in reply to our marketing texts, or by contacting us using the details provided in the HOW CAN YOU CONTACT US ABOUT THIS NOTICE? section below. Even if you opt out of marketing, we may still communicate with you — for example, to send you service-related messages that are related to the administration and use of your account, to respond to service requests, or for other non-marketing purposes.
  • Cookies and other technologies: Most web browsers are set to accept cookies by default. If you prefer, you can usually choose to set your browser to remove cookies and to reject cookies. If you choose to remove cookies or reject cookies, this could affect certain features or services of our Services. You may also opt out of interest-based advertising by advertisers on our Services.

CONTROLS FOR DO-NOT-TRACK FEATURES

Most web browsers and some mobile operating systems and mobile applications include a Do-Not-Track ("DNT") feature or setting you can activate to signal your privacy preference not to have data about your online browsing activities monitored and collected. At this stage no uniform technology standard for recognizing and implementing DNT signals has been finalized. As such, we do not currently respond to DNT browser signals or any other mechanism that automatically communicates your choice not to be tracked online. If a standard for online tracking is adopted that we must follow in the future, we will inform you about that practice in a revised version of this privacy notice.

DISCLOSURES FOR CALIFORNIA RESIDENTS

Shine the Light

California Civil Code Section 1798.83, also known as the "Shine The Light" law, permits our users who are California residents to request and obtain from us, once a year and free of charge, information about categories of personal information (if any) we disclosed to third parties for direct marketing purposes and the names and addresses of all third parties with which we shared personal information in the immediately preceding calendar year. We use and disclose Sensitive Personal Information for the following business purposes: (i) performing services or providing goods reasonably expected by an average consumer; (ii) detecting security incidents; (iii) resisting malicious, deceptive, or illegal actions; (iv) ensuring the physical safety of individuals; (v) for short-term, transient use, including non-personalized advertising; (vi) performing or providing internal business services; and (vii) verifying or maintaining the quality or safety of a service or device. Depending on your cookie settings and preferences, we may also use your Sensitive Personal Information to deliver targeted advertising to you.

California residents have the following rights under the CCPA:

  • The right to know: You have the right to request to know the categories and specific pieces of personal information we have collected about you; the categories of sources from which that personal information was collected; and how we have sold, shared, or otherwise disclosed your personal information.
  • The right to correct: You may have the right to request that we correct inaccurate personal information that we maintain about you.
  • The right to delete: You have the right to request that we delete the personal information that we have collected or maintain about you. You may use an authorized agent to submit a request. When we verify your agent’s request, we may verify your identity and request a signed document from your agent that authorizes your agent to make the request on your behalf. To protect your personal information, we reserve the right to deny a request from an agent that does not submit proof that they have been authorized by you to act on their behalf.

We will take steps to verify your identity before processing your request. We will not fulfill your request unless you have provided sufficient information for us to reasonably verify you are the individual about whom we collected personal information. We will only use the personal information provided in the verification process to verify your identity or authority to make a request and to track and document request responses unless you initially provided the information for another purpose.

INTERNATIONAL TRANSFERS

Our Services are intended to be used by individuals located in the U.S. If you use our Services from outside of the U.S., your information will be transferred to, processed in, and subject to the laws of the U.S. U.S., which may be different than those in your country.

We may update this privacy notice from time to time. The updated version will be indicated by an updated "Revised" date and the updated version will be effective as soon as it is accessible.
